Where Does Indivisible CO Stand?
Initiative 95 – Notification of U.S. Department of Homeland Security for Certain Criminal Charges and Immigration Status Initiative
Indivisible CO recommends a NO vote
A “no” vote opposes amending the Colorado Constitution to require state and local law enforcement to notify the U.S. Department of Homeland Security after charging an individual when: the individual is not lawfully present in the United States or if their immigration status cannot be determined after a reasonable effort by law enforcement; and either the individual is charged with a crime of violence, as defined by law, or the individual has been convicted of a prior felony. Vote NO to ensure fairness and due process under the law for everyone.

Initiative 85 – Penalties for Fentanyl Sale and Possession Initiative
Indivisible CO recommends a NO vote
A “no” vote opposes this ballot initiative, thereby keeping: the possession of less than one gram of fentanyl classified as a misdemeanor; determining whether an individual faces a Level 1, 2, 3, or 4 drug felony based on the amount of fentanyl being distributed or sold; court-ordered treatment discretionary; and exceptions for Level 4 drug felonies in determining whether an individual is deemed a habitual criminal. Vote NO so that persons with substance abuse problems are not criminalized or sent to jail. This does not address substance abuse and further stresses the prison system.

Initiative 110 – Prohibit Surgeries for Treatment in Response to Minors’ Perception of Sex or Gender Measure
Indivisible CO recommends a NO vote
A “no” vote opposes this initiative to prohibit healthcare professionals from performing or providing surgeries to individuals under age 18 for the purpose of altering biological sex characteristics, defined as “treatment in response to a minor’s perception of sex or gender”; and prohibit the use of state or federal funds, Medicaid reimbursements, or insurance coverage to pay for such procedures. Vote NO to give the right to medical care to all and to protect healthcare workers.

Initiative 108 – Require Life in Prison for Human Trafficking of Minors Measure
Indivisible CO recommends a NO vote
A “no” vote opposes this ballot initiative, keeping human trafficking of a child for sexual servitude classified as a class 2 felony, punishable by eight to 24 years in prison. Vote NO: this does not support best practice for supporting survivors. It is best practice to allow the experts in the court system to evaluate the details of each individual case to determine the appropriate sentences/outcomes. This may include, in part, the type and level of participation of the defendant, keeping in mind that the defendant may also be a victim.
Initiative 109 – Sex Requirement for School and College Sports Initiative
Indivisible CO recommends a NO vote
A “no” vote opposes requiring student athletes to participate on men’s or women’s school and collegiate athletic teams that match their sex, defined as biological reproductive systems. Vote NO to say no to sowing hate and fear. There are very few children who are trans and even less who also play sports. Males are not “invading” female sports teams.

Ask questions about where the funding comes from, how this will impact our environment, and how it will impact our state’s revenue in future years. It’s better not to sign, if you are unsure!
